2. Products and Disclaimers (Seed Specifics)
We specialize in rare and hardy alpine seeds. Please be aware of the following specific conditions regarding our products:
2.1. Nature of Goods: Seeds are living products. While we ensure our seeds are fresh and stored correctly, germination depends on many factors outside our control (substrate, temperature, moisture, skill). Therefore, we cannot guarantee specific germination rates.
2.2. Variety Correctness: We take great care to ensure seeds are “true to name.” However, in the rare event of a cross-pollination error or mislabeling, our liability is strictly limited to the replacement of the seeds or a refund of the purchase price. We are not liable for any consequential loss (e.g., loss of time, crop yield, or gardening supplies).
2.3. Intended Use: Our seeds are sold primarily for private use, hobby gardening, and conservation purposes.
3. Prices and Payment
3.1. Currency: All prices are displayed in EUR (€) and include applicable VAT (unless otherwise stated).
3.2. Payment Methods: Payment is charged at the time of the order or when the goods are dispatched, depending on the payment method used.
3.3. Pricing Errors: If a product is listed at an obviously incorrect price due to a technical error, we reserve the right to cancel the order and refund you.
4. Delivery and Shipping
4.1. Global Shipping: We ship worldwide, but delivery is only guaranteed for orders within the EU.
4.2. Buyer Responsibility: Customers outside the EU order at their own risk. By purchasing, you agree that you are responsible for knowing your country’s import regulations. We are not liable for any taxes, customs duties, or items seized/destroyed by border authorities.
4.3. No Specialized Certification: We do not offer packing under the APHIS “Small Lots of Seeds” program or provide phytosanitary certificates. Compliance with all local import requirements is the sole responsibility of the buyer.
4.4. Delivery Time: We aim to dispatch orders within 5 business days. Delivery times vary by country but generally take 4-7 business days within the EU.
5. Right of Withdrawal (Returns)
As an EU consumer, you have the right to cancel your order within 14 days without giving a reason.
5.1. Timeframe: The withdrawal period expires 14 days after the day you (or a third party indicated by you) receive the goods.
5.2. Notification: To exercise this right, you must inform us via email at hello [at] chinesealpines.com.
5.3. Condition of Returns:
The seeds must be returned in their original, unopened packaging.
Due to the biological nature of the product, we cannot accept returns of open seed packets, as we cannot guarantee their viability or purity once opened.
5.4. Refund: We will refund all payments received from you, including the costs of delivery (standard shipping), within 14 days of receiving the returned goods.
5.5. Return Shipping: You (the customer) are responsible for the direct cost of returning the goods.
6. Claims and Defects (Warranty)
You are covered by the standard legal guarantee of conformity (in Denmark: Reklamationsret).
6.1. Reporting Defects: If the seeds arrive damaged (e.g., crushed packet, water damage) or are incorrect, please contact us within reasonable time (ideally within 48 hours of delivery) with a photo of the issue.
6.2. Resolution: We will offer a replacement or a full refund for defective items.
7. Limitation of Liability
To the fullest extent permitted by law, ChineseAlpines.com shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our seeds. Our total liability for any claim shall not exceed the purchase price of the product paid by the customer.
8. Privacy Policy
We respect your privacy. Your personal data (name, address, email) is used solely for processing your order and is handled in accordance with the GDPR. We do not sell your data to third parties.
9. Governing Law
These Terms and Conditions are governed by the laws of Denmark. Any disputes that cannot be resolved amicably shall be settled by the courts of Denmark.
